Terms of Service

These terms are the agreement between you and BourbonDropMap (“BourbonDropMap”, “we”) for the BourbonDropMap website and mobile app (the “service”). By creating an account or using the service you agree to them. Our Privacy Policy explains what we collect and is part of this agreement.

1. Who can use the service

You must be of legal drinking age where you live — 21 or older in the United States — to use the service. By using it you confirm that you are. The service is not directed at anyone under 21, and we do not knowingly let anyone under 21 create an account.

2. What the service is, and is not

BourbonDropMap is informational. It shows where allocated spirits have been seen — from state liquor-authority data where it exists and from sightings reported by people like you — together with store information and, where a state runs one, lottery dates.

We do not sell, ship, deliver, reserve, hold, transfer or facilitate the purchase of alcohol. We are not a retailer, wholesaler, distributor, or an agent of any of them, and we take no part in any sale. Whether a store sells a bottle to you is entirely between you and that store, under the laws that apply to you both.

3. Availability is an estimate

Everything about availability is an estimate as of the time shown next to it. State feeds update on their own schedules and are sometimes wrong; a sighting is one person’s report of one moment; bottles sell within minutes. A bottle we show as on the shelf may be gone, and a bottle we show as gone may be there. Prices are what a feed or a contributor reported, not an offer by anyone. Do not travel, spend, or make decisions on the assumption that our information is complete or current.

4. Your account

  • You need an account to report sightings, keep a watchlist, or receive alerts. Browsing needs none.
  • Sign-in is provided by Clerk. Keep your sign-in method secure; what happens under your account is your responsibility until you tell us it was compromised.
  • One person, one account. Do not share an account or create accounts to evade a limit or a removal.
  • You can export your data and delete your account at any time from your account page on the web or from the app — see “Ending your account” below.

5. Your photos and sightings

You own the photos you take and the sightings you write. So that we can show them, you grant BourbonDropMap a non-exclusive, perpetual, irrevocable, worldwide, royalty-free licence to store, reproduce, resize, display and distribute the photos and sighting details you submit, in the service and in material that promotes it, and to create renditions of them (thumbnails and web-sized copies). This licence survives deletion of your account: a validated sighting and its photo are part of the availability record and stay in the service, without your name.

You confirm that you took the photo (or have the right to grant this licence), that it shows a bottle on a shelf or a shelf tag and not a person, and that your sighting is what you actually saw. We strip camera metadata (including GPS) from the photo file before it is shown to anyone, and public pages never show a contributor photo; a moderator may promote a clear photo to be the bottle’s display image. Where we show a photo, we may crop, resize and compress it.

If a photo shows something that should not be public — a person, a receipt, a licence plate — tell us at the address below and we will remove it from view.

6. Contributor conduct

When you use the service you agree not to:

  • report a sighting you did not personally see, or alter a photo, price, quantity or time;
  • post confidential information obtained as a store employee or from a distributor, or anything you were told in confidence;
  • post content that identifies, harasses, threatens or defames a person, including store staff;
  • use the service to arrange, advertise or solicit a sale, trade or delivery of alcohol, or to help anyone under 21 obtain it;
  • scrape, crawl, mirror or bulk-download the service, or access it with automated tools other than the app and website we provide;
  • interfere with the service, other users, or the stores and state agencies whose data we use.

7. Moderation and removal

Sightings are reviewed — automatically, by other sightings that agree with them, and by our moderators. We may hold, reject, hide or remove any sighting, photo or note, and correct a store or bottle it refers to, at our discretion and without notice. A rejected sighting stays in your own history, marked as rejected. We may limit how often an account can submit.

8. Ending your account

You can delete your account at any time: on the web at /account, or in the app under You → Account & data. Deleting removes your sign-in, your name, your watchlist, your alert settings and your registered devices. Your validated sightings and their photos stay in the availability record, no longer connected to a name, as section 5 describes. We may also suspend or end an account that breaks these terms, or that we reasonably believe is automated, fraudulent or under 21.

9. Our content

The service, its design, its software and the compiled availability record are ours or licensed to us. You may use the service for your own, personal, non-commercial bourbon hunting. Brand names, bottle names and store names belong to their owners and appear here only to identify what and where. Category placeholder images are ours; third-party product images are shown from the rights-holder’s own site and are not copied by us.

10. No warranty

The service is provided as is and as available, without warranties of any kind, express or implied, including accuracy, availability, merchantability, fitness for a particular purpose and non-infringement. We do not promise that any bottle will be where we say it is, that the service will be uninterrupted or error-free, or that an alert will arrive in time.

11. Limitation of liability

To the fullest extent the law allows, BourbonDropMap and the people who work on it are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data, wasted travel, or a bottle you did not get, arising from your use of or inability to use the service. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim (today: nothing) and fifty US dollars. Some jurisdictions do not allow some of these limits; where they do not, the limits apply to the extent they are allowed.

12. Governing law

These terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules, and any dispute will be brought in the state or federal courts located there. If a part of these terms is found unenforceable, the rest still applies.

13. Changes to these terms

We may change these terms. When we do, we update the effective date at the top of this page and, for a material change, tell signed-in users in the app or by email before it takes effect. Using the service after that date means you accept the change.
